ARCaptcha Terms of Use

1. Parties & Definitions

These Terms of Use (“Terms”) govern your access to and use of ARCaptcha’s services (the “Service” or “Services”). “ARCaptcha”, “we”, “us”, or “our” refers to the company headquartered in Turkey, operating under Turkish law and EU regulations. “User” or “Customer” refers to any individual or entity using the Services.

2. Eligibility

• You must be at least 18 years old or have the legal capacity to enter into these Terms.
• If you use the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization.
• All information you provide must be accurate, complete, and kept up to date.

3. Accounts & Security

• You are responsible for safeguarding your account credentials, including passwords and API keys.
• You agree to notify ARCaptcha immediately of any unauthorized use of your account or any other breach of security.

4. Data Protection & Privacy

• ARCaptcha complies with the EU General Data Protection Regulation (GDPR) and relevant Turkish data protection laws.
• All servers are located within the EU.
• When ARCaptcha processes data on behalf of Customers, a Data Processing Agreement (DPA) will apply.
• We may use aggregated or de-identified data for analytics, service improvements, and security.

5. Acceptable Use

You agree not to use the Service to:

• Violate any law or regulation.
• Infringe intellectual property, privacy, or other rights of third parties.
• Distribute malicious software, spam, or fraudulent content.
• Misuse the Service through bots, scripts, or automated systems in ways not intended by ARCaptcha.

6. Service Provision

• The Service is provided on an “as is” and “as available” basis.
• While we make reasonable efforts to maintain availability and security, we do not guarantee uninterrupted operation.
• Customers are responsible for proper integration and compliance with applicable laws.

7. Intellectual Property

• ARCaptcha retains all rights, title, and interest in its software, APIs, trademarks, and other intellectual property.
• Users may not copy, modify, reverse engineer, or distribute ARCaptcha’s intellectual property without prior written permission.

8. Liability & Disclaimers

Our liability for damages is limited: we will not be liable for indirect, incidental, special, punitive, or consequential damages. Our total liability will not exceed the fees you have paid us for use of the Service in the last 12 months.

9. Dispute Resolution & Governing Law

Disputes will be resolved either in court or via arbitration subject to local regulations. These Terms are governed by the laws of Turkey and applicable European Union regulations.

10. Termination & Suspension

• ARCaptcha may suspend or terminate your access if you violate these Terms or for other legitimate reasons such as misuse or security concerns.
• Upon termination, you remain responsible for any fees or obligations incurred prior to termination.

11. Amendments

ARCaptcha may revise these Terms from time to time. Material changes will be notified by email, and your continued use after the change constitutes acceptance.

12. Notices

All notices or communications will be provided via email or posted on our website.

13. Miscellaneous

• These Terms constitute the entire agreement between you and ARCaptcha regarding the Service.
• If any provision is found invalid or unenforceable, the remaining provisions remain in full force and effect.
